Conveyancing, leasing and advice on the unique legal issues associated with agribusiness law and rural properties.
Many of our team members have a personal connection to agricultural or rural properties in New South Wales. We understand the commercial and legal drivers affecting owners of these properties and advise on a range of relevant legal issues. We have experience in dealing in a wide range of agribusiness law matters. Our recent experience includes acting in the sale of one of the largest cattle stations in the Hunter Valley, advising on environmental and property law issues arising in respect of the purchase and lease of several vineyards, resolving a complex dispute over water licence rights and negotiating access and compensation agreements in respect of a proposed mining project.
Clients often seek our advice when considering sales, succession planning and growth financing. We undertake vendor due diligence to assist our clients in preparing their land for marketing and can assist with structuring a land or business sale transaction. For purchasers, we undertake a suite of searches carefully tailored to the property and proposed land use.
Water rights and irrigation schemes are crucial to rural land transactions. We advise owners and purchasers on rights and obligations pursuant to water licences and regulations. We also advise on investigations into water management works by the Department of Industry. Property advisers and other lawyers recognise our expertise in this area and regularly refer us matters involving water law.
Many of the rural land matters we act on involve pastoral leases or licences. We are experienced in advising on Crown land issues and procuring the transfer of Crown leases and licences.
We have advised on significant cross-border transactions involving Foreign Investment Review Board approval and have written extensively about the recent changes to the way in which foreign investment in Australian land is monitored.
