Aboriginal land and cultural heritage rights are specialist areas which tend to be poorly understood. At SWS Lawyers, we have experience in advising on the legal framework here in New South Wales and elsewhere around Australia.
The Aboriginal Land Rights Act 1983 (NSW) established a system of governance and land title that remains distinct from native title. We have negotiated agreements with Local Aboriginal Land Councils established under the ALRA as well as native title agreements. We are also experienced in advising on rights, rules and governance issues under both the Aboriginal land rights and native title legislation.
Property development by Local Aboriginal Land Councils is highly regulated. Our team advises on the process and approvals required. We also understand many of the unique considerations that need to be taken into account when deciding to develop or sell such land.
Our team members have advised on Aboriginal cultural heritage issues and agreements in several Australian states.
Our practice does not act in native title litigation or Aboriginal land rights claims but we have a network of legal experts to whom we refer these matters.
